Mumbai: Mumbai Supreme Court has allowed a 19-year-old student to retake the improvement exam to Class XII because I was suffering from depression and Internet gaming disorder During last year’s exam.
A division bench of Justices AS Chandurkar and Rajesh Patil, in its July 4 order, said the boy deserves to be given an opportunity to appear for the upgrading examination for his Higher Secondary School Certificate (HSC) in the interest of justice.
In his plea, the boy said that he had always been an above-average student and used to score 85-93% marks till 11th class. However, when he appeared for his 12th class examination in March 2023, he was suffering from depression and hence managed to score only 316 marks out of 600, according to the plea. The petitioner claimed that he was under treatment for depression and anxiety from July 2023 to December 2023.
The statement said he also underwent treatment at the Bhabha Atomic Research Centre Hospital, adding that he was diagnosed with internet gaming disorder, due to which he could not appear for the re-examination to be held in July 2023.
The petitioner said he approached the High Court after the university rejected his application to appear for the improvement exam to be held in March 2024.
In the statement, the boy said another improvement exam is scheduled for July 16 this year.
The court, after examining the boy’s medical records, said he was undergoing treatment for Internet gaming disorder.
“The authenticity of the documents is not in doubt. In view of the particular facts of the case, we are of the view that the petitioner should be given an opportunity to try and improve his marks as he was unable to do so earlier due to medical reasons. In our view, the medical documents corroborate the petitioner’s claim that he was unable to take the examination earlier,” the High Court said. pti
