There are good and bad dogs in every single breed known to man. Some bad dogs are also vicious dogs. Not all dog attack injuries however; are caused by vicious dogs. Some dog attack injuries are caused by everyday family pets who have never acted out towards anyone before. You need to exercise caution around any dog, always.
Some dog attack injuries are worse than others, depending on the size and sometimes even the breed of the dog. A bite from a tiny Chihuahua, for example would more than likely appear minor than if the dog had been a large German Shepherd or Rottweiler, Pit Terrier or some other large breed of dog known to be aggressive.
Most often, in a case involving injuries from a vicious dog you would be dealing directly with the animal owner’s homeowner’s insurance company. Most often, these situations are settled out of court. However, sometimes that is not possible, perhaps because the two parties can’t reach an agreement, or perhaps because the owner doesn’t have insurance. In that case, you will be looking at going to court to determine the outcome of the case.
In most if not all dog bite attack cases, several key factors are weighed before a decision is made in resolving a case that has gone to court to be heard in front of a judge. The judge will want to know where the incident took place, if the dog was secured on its own property or was running at large in its community off of its owners property. The judge will also be interested in knowing if any incidents have happened with this particular dog prior to this incident, or if it is an isolated case. The judge might consider giving the dog’s owner a warning with specific instructions that the dog is not to be let outside unless it is on a leash in the owner’s care at all times in order to prevent an incident like this happening again in the future.
A dog might bite if it is trying to protect its family. A dog’s intentions might seem reasonable to its owners, but a judge might see the circumstances differently after weighing the facts of the situation. A dog might also bite if it is feeding it’s young, or eating and perceives that someone is going to take their food away. Sadly this is all too often the situation where accidental bites sometimes happen.
After being bitten by a dog, always seek medical treatment. Some bites may be more severe than they initially appear. After seeing the Dr, consider seeking a dog bite attack attorney. You will need to have the advice and counsel of a qualified dog bite attack attorney to see if indeed you should proceed with filing a lawsuit against the owner.
